Personal Injury Time Limits
In general, there is a three year time limit on personal injury claims. This is known as the “triennium”. You have three years from the date of the injury to begin (not conclude) your claim.
There are some exceptions to this rule however. In the case of compensation for industrial diseases you have three years from the date of the diagnosis of the illness to bring your claim. It can take many years for such illnesses, e.g. Asbestos-related conditions, to manifest, and as such, the clock starts to run from the day you are made aware of the injury. The same is true for medical negligence claims.
The three year time limit also applies in a slightly different way to children. The three year limit begins on their 21st birthday.
